How gold gains are taxed

  • Section 42(9) exempts income from the sale of movable property acquired by inheritance or acquired "not in a commercial or profitable manner". Gold kept as savings or as personal jewellery falls under this.
  • If the Revenue Department finds you bought and sold in trade or for profit, the income is business income under section 40(8). You can deduct actual expenses or a flat-rate deduction, and the net income is taxed at 0–35%.
  • VAT: gold bars of at least 96.5% purity are exempt; jewellery carries 7% VAT on the workmanship charge, not the gold content. Shops don't charge VAT when they buy gold back from you.
  • A tax on online gold trading, proposed in late 2025 to slow the baht's rise, was postponed in January 2026 and put on hold in August 2026. An import tax on gold was under study in September 2026 with no decision. Neither affects selling physical gold.

Reporting

  • Exempt gains don't need to be reported.
  • Business income from gold trading goes on the annual personal income tax return (P.N.D. 90) by the end of March.

Losses

  • There's no capital-loss relief for individuals.
  • A trader deducts costs from sales proceeds (actual or flat-rate expenses) in the same year.
The Revenue Code wording is official, but how it applies to gold comes from secondary summaries and tax Q&A sites rather than a Revenue Department ruling. Whether you're trading depends on the facts.
